American Society of Civil Engineers; Obviously a society of Communist conspirators

Do you want to know where the jobs are, people?  They lie under and next to our city streets, where 100 year old pipes and water mains carry the lifeblood of civilization.  Just do the google on "water main break" and see how our society crunbles from the inside.

Every category scored by the Society requires capital investments by governments and could get addressed if the Republican'ts in Congressexcept for the fact they conspire to obstruct every constructive goal of the Obama administration.  Some might call that treason but not me, I'm the reasonable one.

Hope for humanity

As reported by Channel 5 WCVB, Boston, a group of kids, fifth graders no less, did the right thing by getting together to show support ant protect another kid, Danny Keefe, perceived as different.  Young Danny speaks with a speech impediment.

Nevertheless, his parents feel thankful for that because doctors had told them Danny would have severe developmental disabilities, physical and mental, after developing bleeding on the brain soon after birth. Young Danny defied expectations by growing up with only a slight speech impediment.  That leaves him able to form words in his mind but unable to control the muscles to fully prononce them.

That speech impediment and an affinity for wearing a coat and tie to school set him apart from his peers at Mitchell elementary, and so they teased and bullied him.

When a football teamamate found out about the abuse of Danny, his water coach, he organized a support day where the football team all wore a suit and tie to school, just like their friend.

The report quotes several of his friends one of whom, Nicholas Lambert, 10, said: “We’re all human and all the same. We’re all created equal."

With the team gathered together Danny's Mom, Jennifer Connoly, lauded the effirts of the tram and said, "Look at what happened from one person. You all have this in you. You can pay it forward. If you ever have the opportunity to stick up for someone or be their friend, you should do that,” she said.

Reproductive Rights are Civil Rights

While we fight, may Dr. Kenneth Edelin Rest in Peace.  On 30 Dec, Dr. Kenneth Edelin, defender of a lady's right to choose what happens with her body, died in Sarasota, FL, at age 70 as a result of cancer.

Although numbering among his achievments becoming the first black chief resident of obstetrics and gynecolgy at Boston City Hospital, history may best remember him as Doctor convicted of manslaughter for performing an abortion after the United States Supreme Court ruled in Roe vs. Wade that women have a right to control their own bodies and thus terminate their pregnancies.

When the MA Supreme Court overturned his conviction, the decision helped define the parameters of legal abortions.  After his legal fight, Dr. Edelin became a lifetime defender of women's reproductive rights.

[In the book "Broken Justice: A True Story of Race, Sex and Revenge in a Boston Courtroom," Edelin recounted the experiences of his criminal case.

["At the center of this book are the rights of women to control their own bodies, and the rights of doctors to perform legitimate and legal medical procedures," Edelin wrote. "For me, the struggles for reproductive rights for women and Civil Rights for African-Americans are intertwined and at the same time parallel. The denial of these two rights is an attempt by some to control the bodies of others. Both are forms of slavery. We must never let slavery in any form return to America."] emphasis and emphasis squared added by me.
Although one can always find examples of larger sterotypes, let's demolish the framework used by Republicans in state after state to restrict reproductive rights from females: they see any woman seeking an abortion as a slut, perhaps through ignorance or deliberately ignoring consequences of having sex,

Nevertheless the last time I checked, men and women enjoy carnal encounters.  Yet only women get "caught" with consequences.

Let me just guess the vast majority of women seeking abortions would rather not but have come to the conclusion that for them it amounts to the right choice.

Also, no form of birth control proves 100% effective, and the horrible act of rape can produce pregnancy. Ought we as a society force females to carry to term the child of thier rapist?  No, we as a people ought to make sure the conditions of aboption occur in a safe and humane manner.

[“Nobody likes to do abortions,” Dr. Edelin told The New York Times in 1975, “but the least we can do is make it safe and humane.”]

Safe and humane for God forbid some rightwing zealot come home and find their daughter dead from trying to self induce an abortion.

Back in the saddle again!

Back from lack of connect to the all consuming 'net, back from boredom, depths of Mordor, ennui, anger, sex,  back to wreak metaphor writ large upon the English language, to spill my verbal seed, as it were, upon this vast and hopefully everlasting thing we deem the world wide web.

Did I learn anything in my dark night with no connection, elctronic or otherwise?  Hell no.  Since I perceive existence from within myself, all my answers should come from there.  Or mayhaps just have to keep living in the absence of answers.

A nurse said yesterday God has a reason everything.

Hell no, maybe God has no reasons for anything, much less tragedy.  Maybe God created the universe and then just lets it roll on without regrard to supplicants supplications, for to do so would favor some or one human over another, throwing fairness and justice to the winds, letting the forces of physics and time to crush every human dream, to letting people die before their time and to have people weep for them.

Some people have no courage and need to believe in a benevolent deity to comfort them, a patriarchal pimp daddy to take care of them and smite/pimp slap their enemies: whomever they perceive them to be: Democrats, liberals, Russian commies, Chinese commies, Commie commies, and the entire female race who despise bloggers who write from their parents' basements and have lousy personal hygiene.

Lots of times people just feel the need to bend the universe to their will through prayer.  Nevertheless, you can't tell that to a parent with a dying child.

So now what do I do now that my heroic quest after my cervical fracture to stay of a wheelchair has ended with me in a wheelxhair?  Guess I just got to keep rolling on, try to see what happens next, with clear ryes neither waitinf nor hoping for a benevolent deity to roll the dice in my favor.

But Jesus, this makes the second time I have to recover from this shit.

Why can't I catch a break?

Not too bad things about life in a wheelchair

  1. Nothing.  This will seriously suck--for the rest of my life.
  2. My Converse Chuck Taylors should last the rest of my life.
  3. Will have my own seat at crowded events and bars.
  4. With a parka over my head, will have my own homeless shelter.
  5. People too clueless to see me might bruise their shins on the chair.  If not, I can run over their feet.
  6. I can finally get treated with dignity, respect, financial support, and compassion by society at large.       Ha, ha, ha, just kidding.
  7. I can finally get treated with dignity, respect, financial support, and compassion by doctors, nurses, and the medical community at large at large.  Ha, ha, ha, just kidding.
  8. I should finally get some sympathy from females at my local pub.  Ha, ha, ha, just kidding, I wrote should, not will.
  9. At least, this will give total strangers leave to tell me God has a plan for everything, and to tell how Aunt Petunia lost her left leg, right eye, and hearing in the great fireworks mishap of '83 but still remains positive, happy, upbeat, and knits scripture verses on pillows for the heathen.

Microsoft Forgets Users, Shoots Self in Foot

Let me just add, it couldn't have happened to a better company. Miicrosoft for years has made trillions of dollars off captive markets, almost forcing original equipment muanufacturers to ship computers with Windows software. Now that alternatives have emerged, Microsoft almost forces peo ple to go to alternatives.

["Windows 8 is massively more complex [than its predecessors]," Ben Thompson, an independent analyst who covers technology from his website, said in an interview. "It's mentally taxing to use, and a classic example of something borne of strategic need as opposed to an understanding of user needs."

Thompson's take on complexity, and Windows 8's place on the spectrum, started last week when he pondered why Google's Chrome OS, and the Chromebooks it spawned, had gained a small victory in the battle against still-dominant Windows-powered notebooks.

Although he acknowledged that Chromebooks' lower prices contributed to their rise, he also contended that simplicity played a part.

"The problem comes when you overshoot your customer's needs," Thompson wrote on Jan. 6 in a piece on his site. "In that case, it's not simply that the additional performance is not valued by your customers; rather, the bigger problem is that the additional complexity that necessarily accompanies said performance is actively harmful to your customer's user experience. Your product is not only becoming more expensive, but it's actually becoming worse from your customer's point-of-view."]

Republican'ts Hate the Poor

Geez, so nice to see my well-coiffed FL Senator Marco Rubio, Senator Crocodile Tears, can at leasr mouth words about helping the poor while literallly having his fingers crossed.

Meanwhile, Governor Dick Scott, State of Cruel, wants more hundreds of millions in tax break for the rich and pinga for the poor, especially refusal to extend Medicaid coverage.

Don't listen to what the bastards say; watch what they do.

[Suddenly it’s OK, even mandatory, for politicians with national ambitions to talk about helping the poor. This is easy for Democrats, who can go back to being the party of FDR and LBJ. It’s much more difficult for Republicans, who are having a hard time shaking their reputation for reverse Robin-Hoodism, for being the party that takes from the poor and gives to the rich.

And the reason that reputation is so hard to shake is that it’s justified. It’s not much of an exaggeration to say that right now Republicans are doing all they can to hurt the poor, and they would have inflicted vast additional harm if they had won the 2012 election. Moreover, GOP harshness toward the less fortunate isn’t just a matter of spite (although that’s part of it); it’s deeply rooted in the party’s ideology, which is why recent speeches by leading Republicans declaring that they do too care about the poor have been almost completely devoid of policy specifics.

The point is that a party committed to small government and low taxes on the rich is, more or less necessarily, a party committed to hurting, not helping, the poor.

For now, however, Republicans are in a deep sense enemies of America’s poor. And that will remain true no matter how hard the likes of Paul Ryan and Marco Rubio try to convince us otherwise.]

Stoned Crook News: CO mile marker 420 keeps disappearing in a cloud of smoke

In the Ddepartment of painfully obvious since stoners associate 420 with getting stoned, people steal the CO 420 mile marker.

You can just see some kid from Utah smoking bong hits, giggling, and telling his friends where the sign came from.

[DENVER — Colorado officials think a difference of one-hundredth of a mile will be enough to stop thieves from stealing the mile marker 420 sign along Interstate 70.

Amy Ford of the Colorado Department of Transportation says the "MILE 420" sign near Stratton was stolen for the last time sometime in the last year, and officials replaced it with a sign that says "MILE 419.99."

Ford says it's the only "420" sign to be replaced in the state that recently legalized recreational marijuana. Most highways aren't long enough to need one.

The number "420" has long been associated with marijuana, though its origins as a shorthand for pot are murky.

Mile 419.99, about 25 miles from the Kansas border, isn't the only place in Colorado with a fractional mile marker. Cameron Pass in Larimer County has a "MILE 68.5" sign after frequent thefts of the "MILE 69" sign.]

Chris Christie Coulda Killed Somebody

Geniuses who decided to use lane closures to screw with citizens forgot that could and did delay emergency medical vehicles.  People might have died.

Plus, these shit stains on the drawers of the New Jersey body politic forgot that we citizens of the United States have a constitutional right to travel and use the roads.  Conspiracy to deprive us of that right amounts to a criminal offense, no matter what the politicaal "news" chattering class thinks.

Looking at you "Chunk" Todd.

[You've got a right to drive!

Interfering with peoples' ability to drive between states by closing lanes on the George Washington Bridge between New York and New Jersey might be a crime on its own.

Law professors at two different schools pointed TPM to federal civil right laws, in particular Section 241 of Title 18 of the U.S. Code, which begins:

If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same ...

According to Supreme Court precedent, your right to interstate travel is protected under the above statute, said Frank Askin, a professor at Rutgers University School of Law. Federal civil rights statutes also treat the use of federal interstate highways as a protected activity.

In the bridge scandal, the now-infamous "Time for some traffic problems in Fort Lee" email sent from a Christie aide in the governor's office to a Christie ally at the Port Authority could arguably establish a conspiracy, said Burt Neuborne, a professor at New York University School of Law. Neuborne portrayed a charge based on these statutes as close to a slam dunk.] emphasis added because I feel kind of protective of my constitutional rights.]

[Port Authority Executive Director Pat Foye wrote an impassioned email to the general manager of the George Washington Bridge on Sept. 13, arguing that lane closures that spiraled into a major scandal this week were illegal.

Foye's email, addressed to Robert Durando and other Port Authority officials, fumed that he was not included in the decision, which he said was damaging the public safety and the economy. He ordered that it be reversed.

"This hasty and ill-advised decision has resulted in delays to emergency vehicles. I pray that no life has been lost or trip of a hospital- or hospice-bound patient delayed," he wrote. He added: "I believe this hasty and ill-advised decision violates Federal Law and the laws of both States."] emphasis added 'cause this pisses me off

Stupid Crook News: the WORST screwdriver cocktail ever made

Hand sanitizer and orange juice, brother, that ought to kill you quicker than cheap vodka.  Lee, if you read this somehow, email me at and I'll send you a $10 check for cheap vodka.

Hell, I'm incarcerated in a "nursing" home and can't drink now anyhows.  Someone might as well have a drink on me.

Authorities say a man stole 12 bottles of hand sanitizer from a central Pennsylvania hospital so he could mix it with orange juice and drink it for the alcohol it contained.

The Altoona Mirror reports ( ) 51-year-old Lee Ammerman has been mailed a summons requiring him to surrender Feb. 5 on charges of theft and receiving stolen property.

Police say an employee at UPMC Altoona hospital saw Ammerman steal a bottle of sanitizer in October by hiding it in an arm sling he was wearing. They say Ammerman returned to steal more sanitizer twice in December.

Police say they confronted Ammerman, who acknowledged stealing the sanitizer, saying, "I mix the liquid with orange juice."]

‘Snake handlers have religious rights in Tennessee.’”

[(RNS) An East Tennessee serpent-handling pastor’s legal woes are over for now.

After a hearing on Wednesday (Jan. 8), a grand jury decided not to indict the Rev. Andrew Hamblin on charges of violating a state ban on possessing venomous snakes.

In November, state officials seized 53 serpents — including rattlesnakes, copperheads and exotic breeds — from the Tabernacle Church of God in LaFollette, Tenn., where Hamblin is pastor.

Hamblin and his church say the Bible commands them to handle the snakes in worship. They’ve been featured in a National Geographic television series, “Snake Salvation.”

But state law {amd freakin' common fracking sense} bans the possession of venomous snakes.]

"Arbeit Macht Frei"

Great art exists to hold a mirror up to the face of humans so we can see the good and evil which exists within all of us, whether we want to admit it or not.

At certain times, the mirror gets held underneath the nostrils to detect any signs of life given the monstrous, heinous depths to which humans sink, or worse yet willfully choose whether led by others or proudly chosen on their own, the mirror showing us the festering fetid corpse of certain societies.

Even given this artistic expression however, time dulls the senses, the memory, perception our our very conception of ourselves; decades and then centuries pass to obscure the monsters among us, within ourselves.  False prophets come and go, and we console ourselves in essential goodness of humanity.

So we now bandy about metaphors using the word "holocaust" and rob the word of meaning as our accusations and condemning little Hitlers among us.

Bullshit, great art cries; we must always hold vigil against the darkness in our souls and fend it off.

So soon comes a film perhaps edited by Alfred Hitchcock made from film shot by British camera men documenting the horrors of the death camps.

[The British Army Film Unit cameramen who shot the liberation of Bergen-Belsen concentration camp in 1945 used to joke about the reaction of Alfred Hitchcock to the horrific footage they filmed. When Hitchcock first saw the footage, the legendary British director was reportedly so traumatised that he stayed away from Pinewood Studios for a week. Hitchcock may have been the king of horror movies but he was utterly appalled by "the real thing".

In 1945, Hitchcock had been enlisted by his friend and patron Sidney Bernstein to help with a documentary on German wartime atrocities, based on the footage of the camps shot by British and Soviet film units. In the event, that documentary was never seen....

Five of the film's six reels were eventually deposited in the Imperial War Museum and the project was quietly forgotten.

In the 1980s, the footage was discovered in a rusty can in the museum by an American researcher. It was eventually shown in an incomplete version at the Berlin Film Festival in 1984 and then broadcast on American PBS in 1985 under the title Memory of the Camps but in poor quality and without the missing sixth reel....

Now, finally, the film is set to be seen in a version that Hitchcock, Bernstein and the other collaborators intended. The Imperial War Museum has painstakingly restored it using digital technology and has pieced together the extra material from the missing sixth reel....

As Toby Haggith acknowledges, the film is "much more candid" than any of the other documentaries about the camps. Haggith also describes it as "brilliant" and "sophisticated"....

"It's both an alienating film in terms of its subject matter but also one that has a deep humanity and empathy about it," Haggith suggests. "Rather than coming away feeling totally depressed and beaten, there are elements of hope...."] emphasis added 'cause I'm trying ti have faith.

Pot Calls Kettle Black; Marco Rubio Uses Obamace for insurance for family

Well, well, it turns out Senator Marco Rubio, R-Hypocrisy, has availed himself of subsidies given under the Affordable Care Act to provide health care insurance for his family.  Rubio, one of the staunchest of the staunch oponents of the Act, took $10,000 in money from taxpayers to line his own pockets.  Although perfectly legal, Rubio once again showed he has no ethics, morals, sense of dignity, or self respect,  and can crawl under the belly of a snake when it serves his own self interest.

Rubio, the fair haired and well coiffed illegitimate political spawn of Governor JEB!,  could have signed up for the insurance coverage but rejected the governmental welfare as did Senator Lindsey Graham, but no, that might have required a sense of shame.  Even a first grader realizes you can't say with a straight face something bad and then do it.

Rubio, however, ever able to dance on the head of a metaphor, manages to do just that.

[Though a staunch Obamacare critic, U.S. Sen. Marco Rubio has enrolled his family in one of its health plans and will accept a $10,000 federal subsidy that some fellow Republicans rejected as a “special deal.”

Rubio on Monday defended his decision to accept the annual subsidy, and said it wasn’t that special.

“It’s an [employer] contribution,” Rubio said. “It’s available to every employee of the federal government.”

Rubio pointed out that, as a member of Congress, he is required to enroll in an Affordable Care Act plan if he wants health insurance through his employer, the federal government....

Rubio’s decision ....puts him at odds with some Republicans who refuse to accept the federal contribution money in a protest of the Affordable Care Act.....

So far, about 10 other senators and a handful of U.S. House members have rejected or avoided receiving the annual subsidy.....

Sen. Lindsey Graham, R-S.C., didn’t want to wait that long. He made a big deal last week when he announced he was enrolling in Obamacare but rejecting the employer contribution.] emphasis added so I can savor the irony.]

Can Couples Become Happy?

The romantic in me says yes.  The skeptic reads this list of 10 learned behaviors and sees lots of work.  Who wins?

No, seriously, a relationship keeps not score of who wins but, ideally, has 2 humans growing closer together, with all the follies that entails.

You just gotta make a decision and go for it, and cultivate habit laaughing with your partner like Bonnie and Bruce--laugh at yourselves, laugh at them, laugh at the whole frackng world.

[5. Focus more on what your partner does right than what he or she does wrong
If you look for things your partner does wrong, you can always find something. If you look for what he or she does right, you can always find something, too. It all depends on what you want to look for. Happy couples accentuate the positive.

....Happy couples have different habits than unhappy couples. A habit is a discrete behavior that you do automatically and that takes little effort to maintain. It takes 21 days of daily repetition of a new a behavior to become a habit. So select one of the behaviors in the list above to do for 21 days and voila, it will become a habit…and make you happier as a couple. And if you fall off the wagon, don’t despair, just apologize to your partner, ask their forgiveness and recommit yourself to getting back in the habit.]

A Robot may not...allow a human being to come to harm

["There's a relationship between human and robotic science exploration right now," said John Connolly, NASA's acting chief exploration scientist. "The robots we put down on Mars are our avatars right now. They are our eyes, our feet, our hands on the ground that inform us before we get there. Without these robots doing this work, it would be a very risky endeavor getting to Mars."

He added that sending humans to Mars largely depends on the information that robotic rovers and the Mars orbiters send back about the planet's geology, mineral makeup, water reserves and atmosphere.

"The robotic missions on Mars are helping us to handle these big questions," said Connolly.

During a news conference at the Smithsonian National Air and Space Museum in Washington today, Connolly added that Curiosity's discovery of evidence of ancient water flows as well as water in the Martian soil now is the most exciting find NASA has made yet.

"Finding water is like finding gold," said Connolly. "It's the stuff of rocket fuel. It's what astronauts will need. Finding that there are large amounts of water on Mars is the one find that's changed our way of thinking about human exploration of Mars."]

Neil Young, Carnegie Hall, 6 January 2014

[....It's incredible to think that in the past five months, Young has played ridiculously loud, feedback-drenched marathon concerts with Crazy Horse all over Europe, reunited with Crosby, Stills, Nash and Young at the Bridge School Benefit and put together this gentle, nostalgic Carnegie Hall show. At age 68, his voice has lost only a bit of its range, and his guitar playing sounds just like it did the first time he played Carnegie Hall.

It's unclear if he's going to perform this show outside of Carnegie Hall and his four "Honor the Treaties" gigs in Canada later this month, but Neil Young fans should make every possible effort to see it while they can. This is the show they've been waiting to see for years and years.]

Labor Terms Defined

[....DEFINED-BENEFIT PENSION: The good kind of pension plan. This is a retirement plan in which you are guaranteed a specific amount of pay upon retirement, according to a formula 27 people understand. These are regulated and guaranteed. Because they offer workers enough security to rise above being desperate and grateful for an occasional “cake day,” bosses hate them.

DEFINED-CONTRIBUTION PENSION: This is the 401(k)-type plan, in which the boss contributes something, the workers contribute something, and then the employees are free to gamble in the stock market with their retirement just like teeny tiny Warren Buffetts. If they happen to retire in a year when their entire nest egg is swallowed in a rapacious Ponzi scheme stock bubble, that’s the magic of the market. Savor it....

....PUBLIC SECTOR: Type of government job held by actual people, rather than hacks and blowhards. Also known as “big” or “bloated” government. Medicaid Blues: Vanilla Pudding Reflections

OK, stuck in nursing home for physical rehabilitation and of necessity must eat the food here.  Although generally edible, it does have some quirks: like the anonymous, ubiquitous yellow pudding like substance served as desert for every meal but breakfast.

Given the name "vanilla," it may not prove so since it tastes unlike the cheap vanilla ice "cream" served.  But do we really want to know the flavor proper name?  Even though it gets frankly nauseating to eat for dinner and supper for a whole week, we'll just leave the fact finding to others.

Then a funny thing happens.  One day a lunch tray comes without any desert and the plate o' crap looks lonely without it; the heart yearns wistfully for the "vanilla" pudding.  So one asks and the aid dutifully walks to the kitchen to find a desert for her charge and comes back with dry corn bread and news no deserts at all left in the kitchen.

But I find that impossible.  The kitchen has to have something for dessert for supper.  Just get me one of whatever.  The kitchen gods become displeased, sending the aid away roughly, no pudding for you!

But we've seen this before with the cook at first restaurant and first job ever worked, at a steak house in Satellite Beach where the cook manipulated check times on behalf of his favorite waitresses to receive favors from them.

Life has taught bullies abound no matter the walk of life or profession or location.  Some don't think themselves bullies but enforce petty rules with no reason.  Some take pleasure in power, like some nurses who push me around.  So for the first thing, you can't let yourself get mad because they want that.

Just come up with a reason to get what you want and go to the person who can do that, in this case my nurse who took a couple minutes to get me a damn pudding like I craved.

You can't let the bullies know they bother you.  Don't take it personally.

So know when Republican'ts and pundits opine the US must cut entitlements, realize they have no idea this actually means cutting food budgets and staffing levels at these facilities, since companies have to make a profit in our capitalist paradise.  They just want to screw iwth poor people because they can.

My Representative, Daniel Webster, gerrymandered to hell district of white Winter Garden even though he "represents" part of Orlando, wants to cut entitlements and take my pudding away.

Mr.. Webster, spend a week in a wheelchair in long term nursing care and then tell me how you'll vote.

You might learn to love "vanilla" ice cream, Dan.

Stupid Crook News: Remember Woof Means No

[Last Friday, Palm Bay police arrested 22-year-old Joshua Lee Werbicki at a Papa John’s restaurant on Minton Road where he worked, accusing him of repeatedly having sex with the dog, according to police documents. The dog is described as a “family pet” and police say Werbicki lives at the same home where the crime occurred.

Brevard County Animal Services Sgt. Michael Healy said the dog belonged to the man’s roommate, and remains in her custody. Healy said the police notified his agency, and they’re waiting for the police to finish their work on the case. Healy said his agency could potentially seek an injunction to have the pizza guy banned from owning, or living with, any type of animals in Brevard County.

Police documents show the owner of the dog told police the pet has been limping noticeably, signs of physical injury caused by the activity. Police say the dog has been showing signs of fear when approached by family members.

Police say the sexual acts were recorded by in-home surveillance cameras.]

Governor Dick Scott, wasting taxpayers' money since 2011

Governor 48.9% continues his quiotic quest to further screw with poor people by appealing rulings against mandatory drug testing of FL welfare recipients.  Although Dick keeps scrooging on poor folks, federal district judge Mary Scriven protected the US Constitution and ruled with common sense, holding: "there is no set of circumstances under which the warrantless, suspicionless drug testing at issue in this case could be constitutionally applied."

Judge Scriven had previously issued an injunction against this campaign slogan made legislation, even though presumably some FL legislators have law degrees and thus ought to have known this law as patently unconstitutional.

Not content to wait for a court hearing, the administration of Dick Scott using private lawyers appealed to US 11th Circuit of Appeals to vacate that stay.  3 judges of the 11th Circuit refused to vacate the stay.  Dick requested a hearing from the full court yet the justices turned aside that appeal.

All that lawyering don't come cheap.

According to FL Watchdog, FL Attorney General Pam Bondi revealed the state spent $90,000 in legal fees on the appeals.  This strains the bounds of logic as the ACLU, just 1 of the organizations challenging the urine testing, files for reimbursement of $313,000 in fees and costs after the injunction order in 2011.

In her most recent order, Jude Scriven pointed to the study presented by the state which found dramatically lower instances of drug use than in the general population, pdf pages 5 & 26.

Just coincidentally and unethically, governor Dick's wife owns stock in Solantic, a company which can perform state mandated drug testing.

My country tis of thee, sweet land of unbridled greed.

Let the lawyers have the last words: [“This should send a message to all lawmakers that the 4th Amendment protects everyone,” stated Randall Berg of the Florida Justice Institute and co-counsel with the ACLU.

“The governor and the Legislature sent their lawyers into court to advance a very startling proposition. They argued that some Floridians, namely poor families with children who qualify for temporary public assistance, are not protected by the Constitution of the United States,” stated ACLU of Florida Executive Director Howard Simon.]

One more reason to not use Windows products

[Windows' error- and crash-reporting system sends a wealth of data unencrypted and in the clear, information that eavesdropping hackers or state security agencies can use to refine and pinpoint their attacks, a researcher said today.

Not coincidentally, over the weekend the popular German newsmagazine Der Spiegel reported that the U.S. National Security Agency (NSA) collects Windows crash reports from its global wiretaps to sniff out details of targeted PCs, including the installed software and operating systems, down to the version numbers and whether the programs or OSes have been patched; application and operating system crashes that signal vulnerabilities that could be exploited with malware; and even the devices and peripherals that have been plugged into the computers.]

Whooping Cranes Make it to Florida

While usually a firm believer in letting Nature work things out, sometimes because of the depradations of the human race we need to give certain species a helping hand.

So we find the situation with whooping cranes, some of the most majestic creatures upon the face of the earth--whether created by God, Goddess, or evolution.  In general, bag on birding like my Facebook buddy Sean Paul Kelly enjoys but nevertheless these regal birds, avian owners of the sky, make my soul sing; I don't know why.

Plus, find it a real hoot that human intervention--having these birds learn to migrate by following an ultra light plane--works for good rather than ill.

[Whooping cranes were on the verge of extinction in the 1940s. Today, there are only about 600 birds in existence, about 445 of those in the wild. Aside from the WCEP birds, the only other migratory population of whooping cranes nests at Wood Buffalo National Park in northern Alberta, Canada and winters at Aransas NWR on the Texas Gulf Coast. A non-migratory flock of approximately 20 birds lives year-round in the central Florida Kissimmee region, and an additional 33 non-migratory cranes live in southern Louisiana.]
